Area Sales Conditions

 

Provider:

The company Cresko S.r.l, based in Italy,Pomezia (Rome), Pontina Vecchia Street Km.33, 200, enrolled at the Chamber of Commerce of Rome (CCIAA), No 687149 from 13/09/1989 and VAT Number: 03665461004 hereinafter referred to as Provider.

Customer:

The party identified by the data declared in the moment of the registration and the acceptance of these terms and conditions hereinafter referred to as Customer.

 

Services:

Through an e-commerce service the Provider supplies the Customer with an online store where can be viewed and purchased various types of flag poles for internal and external use, flags, banners and accessories. The Customer could view the electronic catalogue and all the offers proposed by the Provider and do a purchase under the following  conditions of sale.

 

The right of privacy:

The Provider informs that for visiting any of the websites of the company no registration is requested. Any information, product data-sheets, price lists or basic services could be accessed freely without any personal data to be required.

For using  services such as newsletters or online purchase however is necessary the customer’s data to be inserted. Providing this data is not obligatory, but is needed for establishing and maintaining the contractual relationship with the Provider which in case of refusal would not be possible to be done.

 

The personal data declared by the Customer could be communicated also to:

Third parties that perform some special services on the behalf of the Provider such as delivery of goods, suppliers of particular products requested by the Customer, an accounting office, tax compliance, information managing systems, market researches. Banks that manage payments could have an access too in result of the execution of the contracts.

 

Commercial relationships and cases of non-enforcement of laws protecting consumers:

In accordance with the National and the Community laws currently in force, the economic relationship between the Provider and the Customer is  governed by the customer protection regulations exclusively in the cases when the Customer buys for personal purposes not related to his work.

Thus in cases of a relationship between the Provider and a Customer who buys for purposes related to his work providing a VAT number, the customer protection regulations are not applicable.

 

Prices:

Unless otherwise indicated, all the prices are quoted with "VAT excluded" and are expressed in Euros. The valid prices are always those indicated by the procedure when sending the order to the Provider. The prices of some or of all the products could be changed several times in one day without the necessity of any prior notice.

For each order placed is prepared an invoice which accompanies the goods on delivery. The Provider is not responsible for any taxes imposed by other countries.

 

Payment:

The Customer could choose between different ways of payment:

Note: In this case the you should send a copy of the payment by email or by fax on number 0039068145227 within 7 working days from the date of placing the order. In case of missing payment after expiring these days the order will be CANCELLED. ONLY AFTER RECEIVING THE COPY OF THE PAYMENT THE GOODS WILL BE SHIPPED.

2. Secure Payment by a PAYPAL credit card. 
3. Cash on delivery (only for Italy) with a charge of € 5.00+VAT added.

 

Purchase Orders:

Each order is signed by a unique code (an order number) and contains the forwarding date towards the system, a detailed list of the purchased items, shipment costs, individual and total prices expressed in Euro.

Receiving the order in the proper system does not engage the Provider until a written confirmation will not be sent to the Customer by e-mail on the address indicated in the phase of the first registration.

MINIMUM ORDER AMOUNT: € 30,00 (TRANSPORT COST EXCLUDED)

 

Delivery: costs, delivery times,  transport modes:

The Provider executes the shipment by an express courier company either the Customer may request to withdrawal the goods directly from the Provider’s offices or by some other means agreed with the Provider. (Please, note that we do NOT do shipments in the districts of Livigno and Campione d’Italia)

The transport cost for a delivery by an Express Courier for the zone of Italy (MINOR ISLANDS AND VENICE EXCLUDED) is € 8.00 + VAT, where the charge of € 5.00+VAT is added in case of cash on delivery (fiberglass flagpole transport excluded)

The transport cost for MINOR ISLANDS and VENICE to be quoted.
The transport cost for a delivery by an express courier in Europe (Schengen Area Countries) is € 15.00 (fiberglass flagpole transport excluded). 
Transport FREE of cost for orders superior of € 500.00 (fiberglass flagpole transport excluded).

These fees and other charges related to the transport  and/or the shipment of the products are fully specificated in the order confirmation and in the purchase invoice. At the moment of receiving the goods home, the Customer must verify the integrity of all the packages, the correspondence of the quantity and the quality specified in the accompanying document. In case of mismatch and/or some eventual deformations it will be the Customer to make notable this in the accompanying invoice in order to be asserted the respective rights under penalty of invalidation. The delivery times communicated to the Customer are 2/6 working days and represent the information received from the express courier company, any delays or mismatches to be referred to the courier.

 

Complaints and shipment delays:

The customer has the right to contact the Provider verbally via phone: +39.06.9145226 or via e-mail:info@bandiereonline.it (Italy); sales@allflag.eu (Europe)in case of problems such as delivery errors, dislocations or delays.

Communications like these will be treated with the utmost urgency in order any inconveniences to be resolved and total satisfaction of the Customer to be achieved.

 

Right of Recession:

(For private clients only, not applicable to companies) 
Customer receives written instructions for exerting the right of recession with every order. 
A Customer not satisfied with the product can exert the right of recession (Legislative Decree No. 185 22/05/99 - consumer protection in case of contracts concluded by distance) within a period of 10 working days from the date of receiving the goods by sending a communication via recorded delivery letter with advice of receipt on the following address "Cresko S.r.l, Via Pontina Vecchia Km 33,200, 00040 Italy, Pomezia (Rome) ".
The recession may be done within the same term of period by telegram too, provided that is confirmed by a recorded delivery letter with advice of receipt within the next 48 hours. 
In order to obtain a refund of the fee, within 10 days the Customer shall send back to the Provider's head office (Via Pontina Vecchia Km.33, 200, 00040 Italy, Pomezia (RM) the goods that had been purchased. 
The Customer has the right of recession without any penalty to be applied and the only costs to be charged to the Customer will be the costs for sending back the product and not those for the first shipment which will be charged to the Provider. In favor of a good relationship with the Provider the Customer agrees to maintain and preserve with an utmost care and diligence the received goods for which intends to exert the right of recession, keeping them intact and with the original packaging. All the costs and risks of transport for returning back the products will be completely charged to the Customer. Returning back products that are damaged, deteriorated or with missing original accessories or equipments will not be accepted from the Provider and will be sent back to the Customer where the Customer will be engaged to pay all the transportation costs occurred.
When receiving the goods after all the necessary checks will have been done and provided that all the verifications are in conformity with the above the Provider will proceed with refunding the costs to the Customer.

The Provider engages to execute the refunding costs by bank transfer within 30 (thirty) working days starting from the date of receiving the note from the Customer where the wish of recession is declared.

 

The Customer Guarantees:

The Customer Guarantees, assuming all liability and preserving the Provider from any prejudicial consequences that the personal data declared on the acceptance of these general conditions is accurate and provides insight into the true identity of the Customer, where in case of any change to the data provided undertakes to inform immediately the Provider in a written way or also by e-mail. The Customer is also informed that is needed to supply the Provider with an e-mail address in order to allow forwarding of order confirmations and any other communications.

 

Liability Limitations:

The Provider assumes NO liability for malfunctions, interruptions of services or any incomplete performances appeared due to some major circumstances or due to some other causes when they are not directly attributable to the Provider for his willful misconduct or serious negligence.

 

Electronic Communications Validity:

The Customer agrees that any notifications or any communications related to all the on-line services (including those related to the purchase orders) are done from the Provider by an electronic mail and through Web services, the Customer accepts full validity and declares explicitly not to refuse the contents of the declarations sent or received in an electronic format.

 

Complaints:

The Customer may submit comments and complaints to the Provider by: 
1. Information Page as registered or non-registered user; 
2. Field “Notes” in each Detail Order 
3. Email

By a recorded delivery letter with advice of receipt on the following address "Cresko S.r.l, Via Pontina Vecchia Km 33,200, 00040 Italy, Pomezia (Rome). 

 

Cost of using means of web communication

For all the online services are applied internet connection costs charged by the provider of web services  who supplies the Customer with internet connection and who the Customer should contact if any information on the respective rates is needed.

 

Applicable Law

For all the e-commerce services offered on each of the Provider’s web sites gets applied the law exclusively in force within the European Community.

The Client declares to have read and agree with all the clauses in the following articles of the general conditions of sale on the Provider’s websites:
